Terms and Conditions
The general terms and conditions of sale detailed below only govern the contractual relationship between the User (hereafter referred to as You) and the trader Clovergreen Pty Ltd (hereafter referred to as We) Both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our general conditions of sale, having read them. These Terms and Conditions of Sale are important to you and Clovergreen Pty Ltd as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.
2. Product information
Clovergreen Pty Ltd takes great care when putting information on-line with respect to the essential characteristics of our products, notably with respect to the technical descriptions and the photographs illustrating the products; this is however, within the technical limits that exist and with respect for the best standards on the market.
The prices indicated on the Site are in Australian Dollar (AUD) and include all taxes and delivery charges. We reserve the right to modify our prices at any time but will apply the current rates as indicated to you on the site at the time the order was placed.
We would like to inform you that if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially validated.
Please note that we will honour your order while stock is available.
In the event where one of the products ordered is not available, we will contact you in less than 3 business days as of your order date to inform you how long it will be before we are able to deliver the product.
If there are certain products that are temporarily unavailable, we will send the available products and will pay the shipping fees for the rest of the order. If you choose to refuse, we will reimburse the unavailable product.
5. Delivery methods
Clovergreen Pty Ltd will endeavour to ship by the route which Clovergreen Pty Ltd in its absolute discretion considers to be the most practical considering costs and the required date of delivery.
The products bought on the Site will be delivered to Australia only.
Your goods will be delivered to the address you indicated when you placed your order. Delivery to PO Box will not be accepted.
Clovergreen Pty Ltd does everything in its power to respect the delivery times indicated on the website. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God.
6. Secure payment
Clovergreen Pty Ltd uses PayPal to guarantee the security of your payments.
Unless otherwise agreed, payment is required prior to delivery of the order. The amount printed on an invoice will accompany the goods and be dated with the date of shipment.
Upon reception of your order, we recommend that you verify your products against the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it. Without prejudice with respect to the applicable legal guarantees, we recommend that you address any reservations you may have pertaining to malfunctioning products on the date of delivery as quickly as possible by email to: firstname.lastname@example.org. Returned products can only be accepted for products in their original state, notably with respect to their packaging, accessories and manuals. In the event of non-conformity of the product purchased, the User will have the choice between repair and replacement of the product, except if the desired option has an associated cost that is manifestly disproportionate to the alternative.
7. Guarantees and After Sales Service
Clovergreen Pty Ltd will handle all possible repairs. Whatever the problem is with your product, you must attach with the defective product, a copy of your invoice and the warranty certificate.
Please note, legal guarantees do not apply to repairs for damage caused by external origin (for example, accidents, shocks, fluctuation of electricity etc.) or by the user’s faulty usage of the product such as a non-conforming installation or using said product with incorrect peripherals, accessories or consumables.
The warranty does not cover:
-the abnormal use or non-conforming usage of products. We ask that you consult the user’s manual provided with the products
-malfunctioning due to accessories (power cables etc)
-damage from external sources (shocks, accidents, electricity current fluctuations etc)
The following items worth mentioning would be : (examples, please kindly edit if deemed necessary)
Please use registered post or courier service to return the product, so that the parcel can be tracked.
Please bubble wrap the product for proper protection, as Medklinn will not be responsible for units damaged or lost during transit.
Send via courier (Customers are requested to send in the units at their own cost)
- All faulty unit to be sent into Medklinn Australia at customer own cost.
- Upon checking and identifying the issue, Medklinn Australia will check with customer if they wish to proceed with the repair.
a) If yes, customer to pay for replacement parts and shipping cost. Medklinn Australia will inform customer of the total cost involved and an invoice will be sent to customer for payment prior to proceed with the repair.
b) If no, customer to pay for a service fee of $50 and shipping cost if they required the faulty unit to be sent back.
Naturally the warranty cover does not extend to damage caused by normal wear and tear, accidents, misuse, lack of maintenance, neglect, natural disaster, or other external causes; to damage caused by operating the equipment in a manner outside that described in the instructions. The warranty is considered void if the item has been modified, altered or tampered with by a person (or persons) not authorized by our Store to provide service (not including standard periodic maintenance).
If an item needs to be returned for warranty after the 30-day period from the date of dispatch, postage for both ways will be at the buyer’s expense.
8. Litigation and responsibility
This contract shall come under Australia law. Clovergreen Pty Ltd will not be held responsible should our contract with you fail, for example, because of an Act of God, such as defined by Australia courts, or because of the User’s fault, or because of some unforeseen or insurmountable problem with a third party. We remind you that it is wise to save your data for purchased products. Clovergreen Pty Ltd will not be held liable for the poor use and their consequences on the products purchased from our Site.
9. Protection of personal data
Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, failure to provide these details will result in the cancellation of your order.
By registering on the Site, you agree to provide us with sincere and true information as it concerns you.
10. Intellectual ownership
All the content on the Medklinn Group of Companies site (illustrations, texts, names, brand names, images and videos) is the property of Medklinn Group of Companies, its co-contractors or partners. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by Medklinn Group of Companies.
